Abstract
As stated by the eminent constitutional judge and distinguished jurist Gustavo Zagrebelsky, the doctrine of the Constitution in a material sense has long been a classic theme in contemporary constitutional reflection in Italy and other parts of the world. It has generated multiple agreements and disagreements, but never indifference or a priori refutations, in the attempt to link constitutional norms with the effectiveness of political will and with the suitability of the constitutional text as a vital principle and source of effective order, as well as of the renewal of community life.
Costantino Mortati’s doctrine on the notion of the Constitution in its material sense and the way it can take shape in particular historical forms of the State continues to enjoy credibility due to the analytical description it offers of the real functioning of the political system and its institutions, as well as the role it plays. Likewise, its influence in the reconstruction of the system of international relations has occupied an important place in the development of Italian constitutional legal science of the 20th century, which in turn has transcended into the present century and permeated our continent.
