La crisis climática delante tribunales regionales de derechos humanos: perspectivas comparativas desde Europa

Resumen

Varios retos y cuestiones clave relacionados con la crisis climática siguen sin respuesta definitiva en el derecho internacional de los derechos humanos, a pesar del hecho indiscutible de que la emergencia climática se debe a la actividad humana y a la acción estatal, y da lugar a violaciones de los derechos humanos cada vez más graves. Entre ellos se incluyen la atribución de daños, la aplicación extraterritorial de las obligaciones en materia de derechos humanos, los daños y la reparación o la identificación de los titulares de derechos. En este contexto, el presente artículo sostiene que un enfoque comparativo centrado específicamente en los sistemas interamericano y europeo de derechos humanos ofrece una orientación importante para abordar estas lagunas. De especial interés son la Opinión Consultiva OC-32/25 de la Corte Interamericana, titulada Emergencia climática y derechos humanos, y la sentencia KlimaSeniorinnen del Tribunal Europeo de Derechos Humanos. Ambas aportan valiosas perspectivas sobre la mayoría de las cuestiones mencionadas y tienen el potencial de influir en la evolución de los litigios climáticos. Así pues, a pesar de las notables diferencias sustantivas y procedimentales entre los sistemas de derechos humanos europeo e interamericano, esta jurisprudencia emergente contribuye de manera significativa a aclarar las obligaciones de los Estados en el contexto de la crisis climática. Por lo tanto, es esencial comprender a fondo el sistema europeo de derechos humanos, en especial el Tribunal Europeo de Derechos Humanos, para apreciar plenamente el potencial del enfoque interamericano.
